This was confirmed by Investigations Team. This is contrary to Sch. CH 26.1 Code of Driving Conduct. It is acknowledged that competitor did not complete the race.
The Event Director rules that penalty CH 40.16 applies. A drive through penalty was signalled but not able to be complied with as competitor did not finish the race. 3 licence demerit points. Competitor now has 12 licned demerit points are is to start from the rear of the grid in race 13 - Sch CH. 40.6 applies.

The Assistant Event Director-Investigations finds that having viewed film evidence and discusion with competitor #27 Scott McKelvie it is established that: During race 17 of Battery Town 200 at Taupo the competitor impeded a passing attempt by Ute #4 Simon Beirne. Video Footage clearly shows Ute #27 changes direction during the manoeuvre . This caused a disadvantage to Ute #4 from which #27 gained track position. This was confirmed by Investigations Team. This is contrary to Sch. CH 26.1 Code of Driving Conduct.
The Assistant Event Director-Investigations rules that pwnalty CH 40.16 is imposed. 50 secs added to race time and 3 licence demerit points. If this penalty does not correct competitors placing in relation to #4 the competitor will be placed immediately behind him in the results.

This happened after the sart signal of race 4 and before the first corner. This caused car #26 Tim Edgell to leave the track and #15 gained track position because of this. This was confirmed by the Investigations Team. This is contrary to Sch. CH 26.1 Code of Driving Conduct.

The Event Director finds that at the conclusion of race 13 the cylinder head on competitor #6's vehicle was inspected by MSNZ Technical team. As a result of the inspection it was reported that it did not comply with Sch. TL, part C Art. 11.9(3) as the combustion chamber did not comply with relevant diagram. This report is provided by Rod Taylor who is a Technical Judge weights and measures for this meeting. Competitor explained the processed used to obtain the measurement and that it had also been checked by two MSNZ Technical Officers who had been appointed to the meeting. The methodology used was the same for the other similar checks undertaken today. It was established that the measurements were in excess of those on the diagram in Sch TL, Part G that relates to Art. 11.9(3). It was also established that the head was supplied by a third party and it is accepted that the competitors team undertook no machining modification work on it. The head had championship Seal # NZ049416 and this had been fitted on 15 April so it had been in use for Races 4, 9 and 13 at this meeting. The measurement must be considered as performance.
The Event Director rules that penalty CH 40.8 applies - $600 fine. Exclusion from races 4, 9 and 13 at this meeting. Competition licence endorsed until 17 May 2011

The Assistant Event Director-Investigations finds that having viewed film evidence and discussion with car #9 Paul Williams it is established that - #9 performed an unsafe manoeuvre after spinning at turn 8 in that he drove in the reverse direction of travel on the circuit. #9 described this as an attempt to make a U turn. This however meant that he drove directly into oncoming traffic. This in itself is in breach of circuit regulations. This manoeuvre has caused a collision with a following car #7. This is careless driving and in breach of App 4. Sch. Z art 12.1 Code of Driving Conduct.
The Assistant Event Director-Investigations rules that penalty A4Z.11 is imposed. Paul Williams Car #9 is fined a sum of $450; 30 seconds be added to race time and licence be endorsed for a period of 3 months to 16th July 2011.

The Event Director finds that between Rounds 6 (Taupo) and 7 (Hamilton) the right hand head on your vehicle was inspected by Mike Clements & Ron McMillan MSNZ Technical Officers. As a result of the inspection it was reported that it did not comply with SCH TL, Part C Art. 11.9 (3) as the combustion chamber did not comply with the relative diagram. Mike Clements was at the hearing and was able to adequately quantify the measurement methods used and measurements recorded. Ron McMillan was not able to attend but provided a document that supported Mike's evidence. The head, at the request of your engineer supplier, was also independently measured by Taylor Automotive. These measurements supported those recorded by MSNZ Technical Officers. It was established that the measurements were in excess of those on the diagram in Sch TL, part G that relates to Article 11.9 (3). The measurements were accepted by you. It was also established that the head was supplied by a thrid party and it is accepted that your team undertook no machining modification work on it. A submission and supporting argument was also received regarding the appropriate penalty and whether or not the standard penalties can apply to a Championship. These arguements have also failed as Sch P 2.1 (3) requires that in all cases the standard penalty shall be applied. The exceptions to this are clearly marked, however the offence in this case does not fall within their parameters. There is no provision for me to go outside these requirements. Penalty CH 40.11.3 is clearly designed to be used over a championship season and in situations such as this. A written statement from Barry Carrington Championship Scrutineer, confirms that the engine ID with seal was fitted on 7 Nov 2011 and used at Rounds1-6. You confirmed this and that you had not had an engine change during the series.
The Event Director rules that Penalty CH 40.11.3 applies. $600 fine. Exclusion from all races in rounds 1-6 inclusive.
