The Event Director finds that a complaint was received from Car #7 (TR86 Championship) Matt Lockwood, that following Race One (R6) he was hit in the face by Keith Houston, team manager of Jack Milligan’s race team – Car #17, TR86. The entry form for Jack Milligan shows “Carevets NZ Ltd” with an email address of keith@carevets.co.nz listed as the entrant, however this entity does not hold an entrant’s licence so he has been deleted from the entry form. Keith Houston does not hold a MSNZ licence. It is my view that Keith Houston falls outside of the Sport’s jurisdiction at the meeting. Keith Houston is listed as the team manager of the race team of Car 17 on the entry form. On the rear of the entry form the competitor warrants that “all team members attending will be at all times responsible for their own safety and by their actions or inactions will not cause harm to themselves or to any other person”. The National Sporting Code, article 36(n) also states:(n) The competitor shall be responsible for all acts or omissions on the part of any person taking part in, or providing a service in connection with, an event or a championship on their behalf, including in particular their employees, direct or indirect, their drivers, mechanics, consultants, service providers or passengers, as well as any person to whom the competitor has allowed access to the Reserved areas.It is my view that the driver of the car is responsible for a team member’s actions. On the information provided I decided to hold a hearing. I issued a summons to Jack Milligan to appear at a hearing at 1845 hrs on Saturday 21 January 2017 in connection with “an assault by your team member, Keith Houston on competitor #7 Matt Lockwood after Race One (R6)”. The hearing was conducted in accordance with Schedule G 3.2(2), in attendance at the hearing was Jack Milligan, Maria Houston, Matt Lockwood and Raymond Bennett.At the hearing it was ascertained that there had been an incident between the two competitors i

Whilst these issues in no doubt caused Lockwood to become aggrieved it should have been left with the Race Officials to deal with. The actions of Lockwood to storm into Milligan’s pit and confront Milligan were not appropriate and I am in no doubt added to the tension already present from the on-track issues. All that said, there is no excuse for anyone to physically hit someone else at a race meeting. The contact was an open hand slap has to be viewed at the lower end of a physical assault. As previously mentioned, Keith Houston doesn’t fall within the jurisdiction of MotorSport NZ therefore any penalty must be applied to the driver. In applying a penalty I am required to apply Schedule P of the NSC. The penalty is Schedule P NSC.4 as there is no specific penalty in Schedule P of the NSC that addresses this matter. The standard penalty for NSC.4 is a $500 fine with additional penalties being exclusion from the series, meeting or event and/or endorsement of competitor licence for a minimum of one month and a maximum of 12 months. It is my view that a monetary penalty is appropriate and that a licence endorsement for the remainder of the series should apply. I do not believe that exclusion is warranted as in my view exclusion is applicable to on track and technical infringements.In assessing the fine I am of the view that a maximum fine of $500 is not sufficient. In my view this constitutes a serious offence. It is my decision that the accusation against Jack Milligan’s team member Keith Houston is proved, but the penalty is insufficient given the nature of the offence. Therefore pursuant to Schedule P 3.1, I am passing this to the Stewards for a sentence to be applied.
